Over the decades human rights advocates have increasingly engaged with economic policy. Until recently this engagement has tended to be reactive and piecemeal, but in the last few years there has been a growing focus on what economies would look like if they were based on human rights. This article reports on an inquiry into whether it is possible to articulate a concept of Human Rights Economics and if so what its main features would be. It presents branches of economics such as ecological economics and feminist economics, noting the new elements these brought to light and succeeded in integrating into economic thought and policy. The article draws on this approach to analyze key human rights principles to discern whether and how these could be articulated in economics. It points out how questioning the assumptions that underlie mainstream economics could have a potentially transformative effect. Finally, the article suggests some steps that can be taken to bring about more human rights-consistent economic thought and practice.

Cette étude analyse l'impact sur les droits des paysans de différents aspects de la politique extérieure suisse, notamment la politique commerciale, la politique relative aux semences et à la diversité biologique, et la coopération au développement. A partir de l'analyse détaillée de ces trois domaines, l'étude formule un nombre de recommandations pour assurer que la politique étrangère suisse soit en cohérence avec les engagements de la Suisse en matière de droits humains. L'analyse est centrée sur la politique étrangère suisse, mais les recommendations s'appliquent également à la politique étrangère d'autres pays.

This study sets out the rationale and the methodology for carrying out human rights impact assessments of Switzerland’s trade agreements, taking as a case study the Comprehensive free trade agreement between the Member States of the European Free Trade Association (EFTA, namely Iceland, Liechtenstein, Norway and Switzerland) and the Member States of Mercosur (Argentina, Brazil, Paraguay and Uruguay). Following HRIA best practice, this study began by consulting stakeholders. The consultations identified 3 areas of concern for further study: (1) intellectual property provisions affecting the right to health, (2) women’s rights, and (3) agriculture trade provisions affecting Indigenous rights. Based on prior experience, the study describes human rights-related concerns in each of these areas for the Mercosur countries, and how these should be assessed from a human rights perspective. It presents the relevant methodology for ex ante human rights impact assessment of the EFTA-Mercosur trade agreement and suggests how indicators should be selected for more detailed ex ante assessment as well as ongoing assessment after the agreement is in force. The study concludes that human rights-based impact assessments of trade agreements are feasible and constitute valuable tools for policy-making.

This article sets out the methodology and findings of a Human Rights Impact Assessment (HRIA) of the Trade in Services Agreement (TiSA) for Mauritius. It presents analysis of possible impacts of services trade liberalisation and deregulation on the right to water, on labour rights and on labour migration. By examining impacts of trade-related policies through the lens of human rights law, this article brings to the fore how an HRIA can strengthen trade policy-making, and how it can provide African negotiators and other stakeholders with legal and conceptual arguments to strengthen their positions in economic negotiating contexts that are often highly complex. The article is a contribution to the literature in that it provides insights into the underexplored area of human rights impacts of liberalisation of trade in services, and in that it illustrates through specific examples how the human rights analytical framework can be applied to services trade negotiations in other fora, and ...

Este artigo aborda estratégias que podem ser adotadas pelos ativistas de direitos humanos para assegurar que o comércio e as normas comerciais promovam, em vez de enfraquecer, tais direitos. Conclui que um modo eficaz de conseguir o respeito pelos direitos humanos no comércio internacional é buscar o diálogo com os responsáveis por essa política nos governos nacionais, e demonstrar que os direitos humanos podem desempenhar um papel positivo no sentido de garantir um sistema de comércio internacional justo e democrático. O artigo mostra ainda que os ativistas atuantes nessa área compartilham preocupações acerca das transações comerciais com grupos desenvolvimentistas, defensores dos direitos da mulher, ambientalistas e outros que já atuam no comércio; e sugere que os defensores de direitos humanos demonstram, ao recorrer a mecanismos relevantes de accountability, como podem tornar as transações comerciais mais eqüitativas e mais favoráveis aos direitos humanos.

Il est possible pour les pays africains de conjuguer libéralisation du commerce, croissance économique et droits de l’homme dans le cadre de la Zone de libre-échange continentale (ZLEC), et ils y trouveront un intérêt économique et politique. C'est une des conclusions de cette étude, menée en 2016-2017 par la Commission des Nations unies pour l'Afrique, l'Office de la Haut Commissaire aux Droits de l'homme et la Friedrich-Ebert-Stiftung. L'étude analyse différents secteurs du commerce sur le continent (particulièrement l'agriculture et les échanges informels) pour conclure que tenir compte des droits humains dans l’élaboration de stratégies de développement économique permet de mieux comprendre les effets distributifs de ces stratégies et ainsi éviter des répercussions discriminatoires à l’encontre des populations les plus vulnérables. Une approche basée sur les droits humains permet également de concevoir des mesures d’accompagnement en vue d’aider les personnes lésées. Le rapport propose des mesures de suivi de la mise en oeuvre de la ZCLEA et des mesures institutionnelles pour favoriser la promotion des droits humains dans le cadre de libéralisation commerciale en afrique.

Does the global trading system operate to the detriment of human rights? Some people think so. Many argue that trade policy interferes with a nation's capacity to develop its own human rights policies in the areas of health, nutrition, and medical services. This article examines that contention by studying how World Trade Organization (WTO) rules limit a country's ability to uphold the right to health for its citizens and suggests ways that human rights norms and mechanisms can be employed as counterweights to socially harmful WTO polices. The author concludes that most commentators agree that human rights are inalienable and thus would prevail in a judicial setting and that human rights mechanisms have been underused by proponents of public health.

Die Erklärung über die Rechte der Kleinbauern und-bäuerinnen und anderer Menschen, die in ländlichen Regionen arbeiten (Erklärung über die Rechte der Kleinbauern und-bäuerinnen) wurde 2018 von den Vereinten Nationen verabschiedet. Die Kleinbauern und-bäuerinnen sind nicht ausreichend in die Entscheidungsprozesse miteinbezogen, die sie betreffen. Die Schweiz muss die Mitwirkung der Kleinbauern und-bäuerinnen in allen Phasen von Entscheidungsprozessen fördern, welche Auswirkungen auf ihr Leben, ihr Land und ihre Existenzgrundlagen haben können. Diese Mitwirkung muss sowohl im Bereich der Menschenrechte als auch in der Konzipierung und Umsetzung von Politik und Programmen zu Entwicklung, Ernährung, Landwirtschaft, biologischer Vielfalt, Saatgut und Handel gesichert sein. Zu diesem Zweck muss die Schweiz ebenfalls die Gründung und Entwicklung starker und unabhängiger Organisationen von Kleinbauern und-bäuerinnen fördern und unterstützen.

This Research Brief lists actions that countries should take to ensure that their foreign policy is consistent with the 2018 UN Declaration on the Rights of Peasants and Other People Working in Rural Areas. The analysis focuses on Swiss foreign policy, specifically in the areas of trade, intellectual property and development cooperation. The Research Brief recommends, inter alia, that better national-level coordination be undertaken so that different foreign policy actors are aware of the country's human rights obligations, and that a tool be developed to assess likely and actual impacts of a proposed policy measure on peasants and on other people working in rural areas. En el presente estudio se exponen los fundamentos y la metodología para llevar a cabo evaluaciones de los impactos de los acuerdos comerciales  en los derechos humanos. Para demostrar por qué y cómo debe realizarse una Evaluación del Impacto en los Derechos Humanos (EIDH), en el presente estudio se toma como ejemplo el Acuerdo General de Libre Comercio entre los Estados miembros de la Asociación Europea de Libre Comercio (AELC, a saber, Islandia, Liechtenstein, Noruega y Suiza) y los Estados miembros del Mercosur (Argentina, Brasil, Paraguay y Uruguay).
Basándose en la experiencia previa, el presente estudio describe las preocupaciones relacionadas con los derechos humanos en cada una de estas áreas para los países del Mercosur, y cómo éstas deben ser evaluadas desde una perspectiva de los derechos humanos. Presenta la metodología pertinente para la evaluación ex ante de los efectos del acuerdo comercial entre la AELC y el Mercosur sobre los derechos humanos y sugiere cómo deben seleccionarse los indicadores para una evaluación ex ante más detallada, así como una evaluación continua después de la entrada en vigor del acuerdo.
En el estudio también se ofrece el contexto y la discusión de lo que una evaluación del impacto en los derechos humanos puede -y no puede- realizar, , a fin de aclarar la función y el valor del enfoque metodológico propuesto. Demuestra que, a pesar de la complejidad de las cuestiones que se plantean, existen metodologías para la evaluación significativa de los impactos de los acuerdos comerciales en los derechos humanos.

This study sets out the rationale and the methodology for carrying out human rights impact assessments of Switzerland’s trade agreements,  taking as a case study the Comprehensive free trade agreement between the Member States of the European Free Trade Association (EFTA, namely Iceland, Liechtenstein, Norway and Switzerland) and the Member States of Mercosur (Argentina, Brazil, Paraguay and Uruguay).

Human rights bodies have articulated the elements of States' obligations to mobilise resources for the resalisation of human rgihts. This publication draws on pronouncements of UN human rights special procedures and treaty bodies to present a detailed examination of what the obligation to mobilise resources entails. It looks inter alia at the legal basis for the obligation, gender issues, human rights impact assessments, tax policies, corruption and austerity measures. Finally, it puts forward recommendations for UN human rights special procedures and treaty bodies.

Whilst some people have profited handsomely from new trading opportunities opened up by technological advances and by liberalization policies, others have suffered. Developing countries have been struggling for years to have their trade-related concerns recognized and acted on by their developed country counterparts. In parallel, civil society groups have been calling attention to ways in which international trade policy goes counter to development, sustainability and equity objectives. 
Today, more than ever, the multilateral trading system has a role to play. Whilst the system needs to be strengthened and supported, it also needs to adjust so as to deal with the criticisms that have been levelled at it.
This chapter details how human rights can contribute, through ensuring clear definition of trade policy objectives, providing tools for assessing the impacts of trade, clarifying international cooperation obligations, and holding private actors accountable.

Qu’est-ce que les citadins considèrent comme étant « la nature » ? Comment sensibiliser les citadins à la nature dans leur entourage ? Est-ce des installations temporaires comme ceux de « urbanature » de la ville de Genève répondent aux exigences d'un programme de Nature en Ville? Cette étude analyse ces questions et conclut que, malgré ses faiblesses et son « coût » environnemental, les installations d’été d’urbanature ont un certain rôle à jouer dans un programme Nature en Ville.

It is possible for African countries to combine trade liberalization, economic growth and human rights within the framework of the African Continental Free Trade Area (AfCFTA). Moreover, they can reap political and economic dividends from doing so. This is one of the conclusions of this study of the AfCFTA in 2016-2017 by the United Nations Commission for Africa, the Office of the High Commissioner for Human Rights and the Friedrich-Ebert-Stiftung.

The study analyses different sectors with a particular focus on agriculture and informal trade, to conclude that taking human rights into account in the development of economic development strategies makes it possible to better understand the distributive effects of these strategies and thus avoid discriminatory repercussions against the most vulnerable populations. A human rights-based approach also makes it possible to design flanking and compensatory measures to help those who may be adversely affected.

The report also sets out recommendations for ongoing monitoring of the AfCFTA during its implementation and operational phases, as well as institutional to promote the promotion of human rights in the context of trade liberalization in Africa.

Mais c'est seulement au cours de ces quarante dernières années que des traités ont su aborder les problèmes de façon suffisamment globale pour être efficaces. Afin de protéger la vie sauvage, le droit international doit tenir compte de multiples facteurs très divers. Il doit éviter de soumettre les habitants les moins riches de la Planète à des règles qui leur soient défavorables pour satisfaire ceux qui voudraient voir protégées les espèces dont ils tirent un profit souvent symbolique.

Zusaininenfsssung: Mit dem Ziel die wilde Tierwelt und die wilde Pflanzenwelt zu schützen, ist das internationale Umweltschutzrecht um das Ende des letzten Jahrhunderts entstanden. Allerdings sind erst im Verlauf der letzten zwanzig Jahre Verträge ausgehandelt worden, die die damit verbundenen Probleme so global zu lösen versuchen, dass sie auch wirksam sind. Zum Schutze der Tierwelt und der Pflanzenwelt muss das internationale Recht eine Reihe höchst unterschiedlicher Faktoren berücksichtigen. Für die Aermsten dieser Welt hat der Schutz der Tierwelt und der Pflanzenwelt keinen symbolischen Wert.

Summary: International treaties for the protection of wildlife marked the beginnings of international environmental law, towards the end of the 20th century. But it is only in the course of the last forty-five years that wildlife treaties have been sufficiently comprehensive to be effective. To protect wildlife, international law has to take into account a complex variety of factors. It must also avoid imposing unfavourable rules on the poorer inhabitants of our planet in order to please the richer inhabitants who would like to see species protected for their symbolic value.

The African Union's planned Continental Free Trade Area (CFTA), which aims to boost intra-African trade, may have significant human rights impacts.  The Office of the High Commissioner for Human Rights, the Economic Commission for Africa and others are carrying out an ex ante human rights impact assessment of the planned CFTA. This is a presentation of this impact assessment, given at a side-event during the annual AU-ECA Conference of African Ministers of economy and finance in March 2017.
